www.humbleci.com is the online store for the exhibition and distribution through the Internet of the products of the company under the distinctive title «BE HUMBLE», hereinafter the Company

Before you start using our e-shop and before each transaction though it, make sure that you have consulted and accept the following terms and conditions that apply specifically for the use of the online store of www.humbleci.com. Any use of the website www.humbleci.com implies your explicit and unconditional consent to these terms.

  1. Terms of Use

The Company reserves the right to unilaterally modify or renew the present terms and conditions, according to its needs and/or the transactional manners. The Company undertakes the obligation to inform the users for any modifications as well as for any change through this present website and eshop. Please note that any change of terms does not refer to orders that you have already placed prior to these changes. Please check the "terms and conditions" page regularly for any changes or modifications.

Please note that the user/customer has the right to place an order through our e-shop if he is legally competent according with the provisions of the Greek Civil Code (i.e. the user/customer is older that eighteenth years old and is not in judicial custody regarding the conclusion of a sales contract). Orders can also be placed by legal representatives of legal entities. The Company reserves the right to claim a refund from the supervisor or guardian of any orders placed by legally incompetent persons.

All transactions through our online store are governed by European and national legislation, among which L. 2251/1994 as applicable from time to time, P.D. 131/2003 and the Consumer Code of Ethics for electronic commerce.

  1. Information provided & product availability

The Company is committed to the completeness, validity and accuracy of the information presented on its website and are related to the services provided and the products sold by our e-shop without prejudice to any technical or typographical errors that have occurred unintentionally. In case that a product is not available the relevant indication will be presented below or next to the product name and code.

If any ordered product is not immediately available and is not listed as such in our e-shop, the Company will inform you as soon as possible by phone or email, without incurring any further liability.

  1. Limitation of liability

The Company, in the context of its transactions through the online store, is not responsible and does not bear any liability for compensation for any damage or loss arising from the cancellation of orders, non-execution or delay in their execution, for any reason whatsoever. The Company does not guarantee the availability of the products displayed in the e-shop, but informs the interested customer based on the relevant data about their availability or not and undertakes in case of change of their status, to inform the customers in time about the non-availability and bears no further responsibility.

Our e-shop displays the content (i.e. information, names, photos, illustrations), products and services "exactly as they are". In no case is the Company liable for any loss (positive, special or negative, which indicatively and not restrictively, divisively and/or cumulatively consists in loss of profits, data, monetary satisfaction, etc.) that a user or a third party may suffer due to a reason related to the operation or not of this e-shop and/or the use of this e-shop and/or inability to provide services and/or information and/or to sale and deliver products and/or from any non- permitted third party interventions in the displayed products and/or services and/or information made available through our e-shop.

The Company is responsible only for willful misconduct and gross negligence in case of delay in the delivery of ordered products and for misleading or incorrect information that it provides for products and/or services provided through its website. Our e-shop is not responsible for any technical problems presented to users when they attempt to access this website or during its visit to it and are related to the operation or compatibility of their own infrastructure. The Company also bears no responsibility for acts or omissions of third parties and especially unauthorized interventions of third parties in products and/or information available through the website of the online store www.humbleci.com.

The links included in the e-shop, lead to pages of the website or in some cases lead the user to go from it (online store) to websites of third party providers, companies, etc. These related websites are not under the control of the Company and the Company is not responsible for the contents of any such website or any link contained in an affiliated website, or any changes or updates of such websites. The Company is not responsible for any broadcasts or for any form of transmission received from any linked website. The Company provides these links in its e-shop only to facilitate the use of the online store, their use is not mandatory for the visitor / customer and the fact that they are included in this present e-shop does not imply that the Company approves or accepts their content.

  1. Intellectual property rights

The website www.humbleci.com is the official e-shop for the exhibition and distribution of the Company's products. All content on the website posted by the Company, including images, graphics, photographs, drawings, texts, services provides and products are the intellectual property of the Company and are protected under the relevant provisions of Greek law, European law and international conventions. Any copying, analogue / digital recording and mechanical reproduction, distribution, transfer, downloading, processing, resale, recreation or any act which could be considered misleading to the public about the actual provider of the content is prohibited. Any reproduction, re-release, downloading, announcement, dissemination, transmission, or any other use of the content in any way or means for commercial or other purposes is permitted only with the prior written permission of the Company. The trademarks, images and logos that represent the Company and/or its e-shop and/or third parties as well as their products or services, are exclusive trademarks of the Company and of those third parties and are protected by Greek, EU and international trademark and industrial and intellectual property laws and the relevant legal provision for unfair competition. In any case, their appearance and display on the website www.humbleci.com should in no way be considered as a transfer or assignment of their license or right to use.

  1. User Obligations

The users of the website and of the e-shop www.humbleci.com accept and undertake the responsibility not to use the website and e-shop of the Company for sending, publishing, sending by e-mail or transmission by other means of any illegal, harmful, threatening, offensive, disturbing, defamatory, defamatory, vulgar, obscene or libelous content. Any such act, which constitutes a breach of the privacy of others, expresses empathy, racial, ethnic or other discrimination and may cause harm to minors in any way is strictly prohibited to be transmitted in accordance with the law and the this present provisions.   1. How to create an account

You are given the option to create an account to make your purchases. In order to create an account on our website, drag the cursor to the upper right corner of the screen and select the relevant icon. Then select the "Create an account" button, fill in the requested information and press the "Create an account" button. You can follow the same procedure every time you want to connect to the account you have already created by pressing the "Login" button. Please do not share your username and password with third parties. If you have forgotten your password after creating an account, follow the above procedure and press the button "Lost your password?" from where you will be given the option to reset your password.

 In the event of an order placed by a third party who has stolen or otherwise obtained knowledge of your above details, contact us and we will take any necessary action in good faith to cancel the order, but we do not guarantee that we will be able to cancel the order, at which case you will need to pay for and collect the products and we will in no way be liable for this.

  1. Order Procedure & Selection-Purchase of products:

Select the product you are interested in buying by clicking on the icon of the item you want and you will be transferred to the relevant page with the detailed description of the product. On this page you can select the quantity of the product you want to buy and the size. After selecting the item you are interested in and the desired quantity and size, click on the option 'Add to cart' and the product / products are automatically transferred to your shopping cart. At the same time, a detailed list of the selected products is displayed on your screen. This status is accessible at any stage of your order, or your navigation at www.humbleci.com. For an overview of the status of the items you have in your cart (items to order) just drag your cursor over the icon of the shopping cart at the top right of your screen, where you will find a detailed list of products to be purchased or press on the 'Cart' button that appears on that icon. You apply the same procedure for each product you are interested in acquiring.

Completing your order: To complete your order you should review your shopping cart as described above and then και press at the option “Proceed to Checkout” which is located at the lower right side of your screen.

Changing the purchase quantity: In case you want to increase or decrease the quantity in an item during the overview of your cart, enter the desired quantity in the corresponding field and then press the “update cart” button and the quantity of the items you are interested in is automatically refreshed.

Deleting one of the products in the shopping cart: If you want to delete one of the products you have selected from your order during the overview of your cart, press the “X” button and it will be automatically removed from your shopping list.

Once you have reached the items and the desired number of products you want to order, proceed to «Proceed to checkout» by clicking on the corresponding button. You are immediately transferred to a new page where you are asked to fill all the required information (name, email, billing address, shipping address if it’s different from billing address), you are able to see the shipping costs and final total and you can choice the payment methods (information about the fees for each payment method are also available at this page)

When filling in your details, you are also given the option to create an account in our online store by pressing the "create an account" button.

Successful registration of the order: Your order is considered to have been successfully registered in our system when an email is sent to your account, with detailed information related to your purchase.

The Company makes every effort to provide high quality services. In case there is a pending issue in your order then a corresponding e-mail will be sent to you. Alternatively we will contact you on the phone number you have given us when you created an account or registered the order on our site. There is no way to deactivate these updates, the sending of which is a prerequisite for the proper processing of your order. We invite you to ensure that these e-mails will reach you and do not delete them throughout the duration of our transaction. It is your obligation, in case you do not receive the relevant e-mails, in accordance with the general terms governing our transactions, to inform us without delay.

All discounts are valid for a predetermined period of time provided that the offered item is also available and in stock. The Company may, according to its commercial policy, determine the maximum number of pieces per transaction in cases of discounts. The charges will be made based on the prices that were valid and were posted on www.humbleci.com at the date and time of submission of the order.

The Company is not responsible for any spelling or numerical errors in the descriptions, prices, offers or discounts at www.humbleci.com. In case of error, every possible effort is made to restore it, as soon as possible. It is noted that in cases of wrong prices due to human error, the price given by the “registry” is always considered valid.

Prices and discounts are valid until the end of the respective promotions or until we are out of stocks. Changes to the prices and offers may be made without prior notice to the customers.

Product prices include VAT. It is noted that for purchases with a place of delivery outside  of Greece, the prices do not include any duties imposed by law and other taxes and charges related to the import of the products into the country of delivery and/or customs clearance thereof and/or imposed by the country of delivery and which should be paid to the relevant authorities of the country of delivery.

- Orders to be delivered within Greece:

For all orders up to sixty euros (€ 60.00) including VAT, shipping costs within Greece are three euros (€ 3.00). For orders up to sixty euros (60.00 €), if you choose "cash on delivery" as a method of payment there is an additional charge of four euros and fifty cents (4.50 €)

For orders over sixty euros (€ 60.00) with VAT, the shipping is FREE and there is no cash on delivery cost.

- Orders to be delivered to Cyprus:

Shipping costs for orders to be delivered to Cyprus with a total value of less than sixty euros (€60.00), including VAT, amount to six euros and twenty cents  (€6.20). For orders with a total value of sixty euros (€60.00) or more, including VAT, the shipping is free. For orders with a place of delivery in Cyprus, the possibility of payment by cash on delivery is not provided.

- Orders to be delivered outside of Greece and Cyprus

The shipping costs for orders with a place of delivery outside Greece and Cyprus for orders with a total value of less than _________ euros (____€) including VAT (excluding any legally imposed duties and other taxes and charges related to the importation of the products into the country of delivery and/or customs clearance thereof and/or fees imposed by the country of delivery) vary depending on the country of delivery and in any case will be notified to you at the stage of completing your order. For orders with a total value of _________ euros (____€) and above including VAT (excluding the above-mentioned charges) the shipping is free. Payment by cash on delivery is not available for orders with a place of delivery outside of Greece.

The delivery time depends on the special circumstances and in each case you will be notified when completing your order. The Company and its associates take all the necessary measures for the timely transfer of your order according to the delivery schedule, however, neither the arrival time nor the exact delivery time of the order products can be guaranteed, as they depend on the conditions of transport. The Company is not responsible for any delays due to force majeure events such as strikes, severe weather conditions etc. In case of any delays the Company will make every effort to inform you.

Also, your order may be delayed in case it is impossible to communicate by phone and / or by e-mail (e-mail) with you (if there is a problem with your order, either in relation to the product or in relation to payment) because eg your personal information entered during check out  are not properly updated. In case the product you ordered is no longer in stock, an employee of our company will contact you as soon as possible to provide you with all the availiable alternatives.

The products are shipped worldwide, at the place you indicate on the order form. The customer is able to choose through the platform www.humbleci.com the delivery method.

Delivery time may be affected by situations of force majeure such as bad weather conditions, ports strikes etc.

Deliveries are made to the address you have chosen. Exceptions are enforced for the inaccessible areas where the local courier store should be consulted. In rare cases the collection will be done from the aforementioned local store.

It should be noted that in the event of delivery of the goods, in accordance with the above, the risk of loss or damage of the goods is transferred to you as a consumer, when you or a third party designated by you and different from the carrier has acquired physical possession of the goods . However, the risk is transferred to the consumer upon delivery to the carrier, if the carrier has been instructed by the consumer to transport the goods and the option of choosing that carrier has not been offered by the supplier, subject to the consumer's rights against the carrier.

  1. Payment Methods & Transaction Security

After confirming the items and the quantity you wish to buy, you complete your order by choosing the desired payment method. The online store www.humbleci.com allows payment in the following ways:

There are three payment methods:

1) You can pay upon completion of your order at www.humbleci.com by credit or debit card. If you choose online payment by card, the amount of your order will be automatically taken out of your account. Our Company is not responsible for actions and/or omissions of third parties such as possible delays or technical problems of any kind during the settlement of transactions by the issuing Bank of your credit/ debit card.

All transactions carried out using a credit or debit card are cleared by Viva Wallet.

Your credit card information is in no way shared or saved by our Company and/or www.humbleci.com nor do we maintain any relevant. In case the order is made on behalf of a company, then the credit card you use must be a company credit card.

2) Cash on delivery upon receipt of your order. Payment in cash to the Courier designated employer. This option is available only for purchases delivered within Greece

3) The online store www.humbleci.com accepts all credit cards i.e VISA, DINERS, MASTERCARD, MAESTRO and AMEX.

4) Using Paypal. Payment via Paypal is subject to its terms and conditions which can be found here

5) Using Apple pay. Payment via Apple pay is subject to its terms and conditions, which you can find here.

            The security of your transaction is ensured by the personal code (password) that you enter when you create an account at www.humbleci.com. To access any of your personal information, you must first log in to your account by entering your username and password. For this reason, you should not share such information with any third party. We also advise you to create a password using symbols along with alphanumeric characters as well as to change your password at regular intervals.

The Company recognizes the importance of security of Personal Data as well as electronic transactions and has taken all necessary measures with the most modern and advanced methods to ensure maximum security.

 

  1. Return – Replacement of Products

If you wish to return products bought via www.humbleci.com you can contact our Company via this present website or by e-mailing contact@humbleci.com . Returns are accepted only on products that are in good condition for sale and have not been worn. The following terms and conditions apply for all product returns.

Returns after delivery of the order due to an error of the store:

 

In all cases in which other than the sold goods are delivered, by type or quantity or there is a missing feature which has been previously agreed upon in writing with the Company, the customer may returns the products to the Company, which will proceed to check the items. In this case, the costs of returning the products to the company as well as the costs of delivery of the right ones to the customer are borne by the Company, as long as the method of return proposed by the company is observed.

For returns due to a store error, the customer must contact the Company by phone at +30 210-9635663 or at contact@humbleci.com beforehand.  For orders with a shipping location outside of Greece, the Company can only be contacted by email to at contact@humbleci.com.

Products Exchange Policy

The Company accepts product exchanges within 14 calendar days from their delivery and only for products that are in good condition, their packaging has not been opened, it is sealed in its factory condition and the product has not been used. The costs of sending the items you wish to exchange to the Company are borne by you. If you wish to exchange a Product, you must return it in accordance with these terms and if the product meets the relevant conditions you can either choose to exchange it with the same product (code) in another size or another product or to get a refund. You must inform the Company for you choice in writing by sending an email to contact@humbleci.com or by phone. Refunds and product exchanges are only possible when they are in accordance with these terms.

If you choose to exchange the purchased product for another product it will be shipped to you provided it is available within five (5) days. As far as shipping costs are concerned, the terms of art. 7 above

Each product can only be exchanged once.

Returns of defective product

The return of the products, which are considered defective upon delivery will be accepted within fourteen (14) calendar days from their delivery to the customer. The product must not be damaged and must be accompanied by all the original documents that came with the product (eg receipt etc.) and be in its complete packaging. In these cases, the following terms apply:

- The product is send to the Company by the customer. The Company will check the product to determine the defect reported by the customer.

- Provided that they have been previously received and checked by the Company, the item will be replaced with a new one of the same product code and size, or in case of that the same product code is not in stock, it will be replaced with another new product of similar quality and price, otherwise in case the customer does not want the replacement, the money of the original purchase will be returned to the latter. The refund is made in the same way as the initial payment was made to the Company.

 

- Please not that the Company will not refund or replace Products:

(a) obtained from a source other than this online store and/or

(b) damaged by abuse or neglect (eg exposure to chemicals, caustic substances, open flame, high heat, sharp object, etc.) and/or

(c) that have been damaged by misuse or other activities outside of their intended purpose

*Please note that the expected usage time of any Product depends on the person using the Product, the conditions of use and the wearer's typical wear patterns. Our Products that are damaged by normal wear or that have exceeded their reasonable lifespan are not replaced.

 

- Shipping costs both for the return of the products to the Company and for the return to the Customer of the replaced product are borne by the Company.

- In case the products are returned damaged or in any condition which is not in accordance with these present terms the Company has the right to request compensation from the customer, the amount of which will be determined by the condition of the products and to unilaterally and without any other notice to Customer proceed in a full or partial offset of this claim against the customer. In the aforementioned case, the Company reserves the right to fully decline the replacement or the refund of the product.  

RIGHT OF WITHDRAWAL: We inform you that according to Law 2251/1994, as amended and in force, as consumers you have a period of fourteen (14) calendar days to withdraw from every contract that you have entered into remotely (distance contracts and off-premises contracts) , without stating the reasons, and we will refund the full amount pay for your order (minus the shipping cost, where applicable). For sales contracts this period expires fourteen (14) calendar days from the day on which the consumer or a third party designated by him, other than the carrier, acquires physical possession of the goods. You can exercise the right of withdrawal with one of the following ways: 1) by using the withdrawal form of our website, 2) by making any other clear statement that presents your decision to withdraw from the contract. Upon receipt of this statement by the customer, the Company is obliged to send a confirmation of receipt of the withdrawal statement as soon as possible.

The Customer must within 14 days from the day the notification for withdrawal was made to the company, to return the product(s), in accordance with the terms of this paragraph. Following the declaration of withdrawal, the Company is obliged to return the payment within 14 days of receipt of the products. The refund to the customer will be made by the same means by which the initial payment was made. Specifically in the case of payment by credit card, the return will be made as follows: in case in which - until the withdrawal and return of the item - the price has been paid to the Company by the Bank, the Company will be obliged to inform the issuing Bank about the cancellation of the transaction and the bank will proceed then in any action appropriate under the contract drawn up with the customer without the Company having any further responsibility. Following this, the Company does not bear any responsibility for the time and manner of execution of the rebuttal, which is regulated by the aforementioned contract. The above apply when the payment was made by Apple Pay and Paypal. In case of payment by cash on delivery, the refund will be made by bank to the Customers bank accounts. In this case, you must notify us in writing of the details of the bank account to which you wish the deposit to be made.

It should be noted that the customer is responsible to compensate the Company if he made use other than necessary to determine the nature, characteristics and operation of the goods in the period until the declaration of withdrawal. The determination of the nature, characteristics and function of the goods should be made on the basis of the information provided on the outer packaging of each product, as well as the additional information provided by the company and in any case without opening the packaging of the products and putting the item in use. The Company will provide any information necessary to the customer regarding the nature and operation of the products by providing additional informational material electronically or otherwise. In case of opening the packaging or putting the products into use, their value is automatically reduced, as the product is characterized as “used” and the customer must compensate the company for reducing the value of the product. The reduction of the value from the opening of the package and consequently from the characterization of the product as “used” is examined on a case by case basis and is determined by the company and is usually in the range of 20% -30%. The Company is entitled to agree with the customer its compensation even with mutual set-off.

- In case the withdrawal concerns the provision of services, the customer must pay an amount in accordance with the services provided until the withdrawal statement services.

- In case the products are returned damaged or incomplete the Company has the right to request compensation from the customer, the amount of which will be determined by the condition of the products and to proceed unilaterally and without any other notice in full or partial offset of this claim against the customer.

In the aforementioned case, the Company reserves the right to fully decline the replacement or the refund of the product

The right of withdrawal, as provided in Articles 3e to 3a for distance contracts and off-premises contracts, shall not apply to the following indicative cases: service contracts after full service, if the execution has begun with the prior express consent of the acknowledging that he will lose his right of withdrawal once the contract has been fully executed by the supplier of the goods or if the execution has begun with the prior explicit consent of the consumer and confirmation by him that he thus loses the right of withdrawal.

We remind you that the seller is responsible for real defects and lack of agreed properties in accordance with articles 534 et seq. of the Civil Code. The rights of the consumer are under the protection of the relevant provisions of law No 2251/1994 on Consumer Protection (FEK A’ 191 / 16.11.1994) as it is currently in force. For any issue that is not explicitly mentioned in these terms of use, the current legislation applies.

  1. Modification / Cancellation of Order

If you have completed the process and you wish to modify / cancel your order, you can do so within 24 hours from the moment of completion In order to modify / cancel your order please contact the Company at contact@humbleci.com.

  1. Money refund

In those cases where the possibility of a refund is provided, this is done in the same way as the customer's initial payment to the Company was made. In particular: (a) in case of payment by credit card, the Company will be obliged to inform the issuing Bank of the cancellation of the transaction and the bank will then proceed to any action appropriate under the contract drawn up with the customer, without the Company having any further responsibility. Following this, the Company does not bear any responsibility for the time and manner of execution of the rebuttal, which is regulated by the aforementioned contract, (b) the provisions of (a) above also apply in the case of payment via Apple pay and Paypal, in which cases the company will inform the providers of the cancellation of the transaction and they will refund the money. Following this, the Company bears no further responsibility and (c) For orders with a place of delivery within Greece where the total price was paid either by cash on delivery or by bank transfer, a reverse bank transfer will be made from the Company's accounts to the customer.

  1. Warranty.

The COMPANY guarantees that its products and the products of third parties (products not produced and/or manufactured by or on its behalf, and which www.humbleci.com resells) are safe and suitable for use according to their intended purpose, all hygiene rules have been followed at all stages that are under its control and the Company has received the corresponding guarantees from its suppliers, who are also responsible before the final consumer. The COMPANY does not guarantee the suitability of the product sold for its use for any specific purpose.

We draw your attention to the washing and care instructions printed on our Products. We are not responsible for any damage resulting from incorrect handling of the Products, including handling contrary to the instructions.

  1. Online Dispute Resolution

The Online Dispute Resolution - ODR platform of the European Commission has been operating since 15/02/2016, allowing both consumers and traders to resolve their disputes online, whether they are related to domestic or cross-border transactions. The ODR is directly linked to the competent Alternative Dispute Resolution (ADR) bodies in each country, which undertake the handling of complaints. Each dispute resolution body applies its own rules and procedures. These are usually simpler, faster and less expensive than going to court. However, the choice of body must be agreed by both parties. In Greece the competent body is the Independent Authority "Consumer Ombudsman” http://www.synigoroskatanaloti.gr/index.html.

The process is carried out in four stages: 1) Submitting a complaint, 2) Agreement on a dispute resolution body, 3) Processing the complaint by the dispute resolution body, 4) Result and termination of the complaint. The process is easy, completed electronically and serves all EU countries. The body must decide within 90 days.

  1. Informative e-mails and newsletters

The Company sends informative emails regularly, if you wish to receive the company news and you have chosen to subscribe to our Newsletter. Those emails from www.humbleci.com are send to you only if you choose so and for as long as you wish. The Company is not responsible for the failure to deliver the newsletters, although it makes every effort with ISP’s (Internet Service providers). The newsletters may end up in the spam folder, so please check it regularly. In case you no longer wish to receive informative e-mails you can unsubscribe by sending an e-mail to contact@humbleci.com. In no case the Company discloses personal data and information about your name, surname, home address, etc. to third parties
